Terms And Conditions

This Trip Agreement (“Agreement”) sets forth the legally binding terms for your travel with Global Renewable Energy Education Network, LLC (“GREEN” or “We”). By purchasing the program, you are agreeing and accepting all terms and conditions that apply within this Agreement and you are entering into a binding and enforceable legal agreement with GREEN (and/or its owners and operators as set forth below). You represent and warrant that you are authorized to enter into this Agreement. Please read these terms and conditions carefully since, by registering for travel with GREEN, you are signifying your assent to this Agreement.

1. HOW TO MAKE A RESERVATION: Reservations may be made by telephone, fax, mail, or online using the contact information below.

2. NORMAL HOURS OF OPERATION (Excluding Major Holidays): Monday-Friday (9:00 a.m. - 9:00 p.m. EST). Saturday (10:00 a.m. - 5:00 p.m. EST).

3. PAYMENTS/DEPOSIT: A full payment is required to finalize a reservation. Some programs may require you to purchase non-refundable airline tickets at the time of booking, in addition to the required tour deposit. There may also be other exceptions.

Final payment is due not later than 21 days before departure. The date will be specified on your invoice.

• If your final payment is not received by the date it was due, we reserve the right to consider this inaction a cancellation.

4. PRICE INCLUDES: The GREEN educational program (the “Program”), transportation to all Program-developed excursions for GREEN-scheduled transportation, $200,000 in emergency medical insurance, twenty-five (25) meals, eleven (11) nights at a variety of hotels of GREEN’s choice, which shall each be at least three (3) stars or better, all Program-developed adventure excursions, official educational tours, and exclusive life time membership to the Global Renewable Energy Education Network.

5. PRICE DOES NOT INCLUDE: Government fees are not included in the price. In addition, we are not permitted to collect certain taxes. These taxes or fees must be paid directly to local authorities. Other items such as incidentals, passport/visa fees, or items of a personal nature are not included in the price. All charges and fees that are required to be pre-paid in addition to the price, will display as separate line items on your invoice.

6. PRICE CHANGES: Our website lists the price and inclusions for the trip, which are subject to change. If a price should change, you may cancel your trip without penalty if we are notified in writing of your intent to cancel within seven (7) days of the price change. All non-refundable charges are exempt from this policy.

7. DOCUMENTS: It is your responsibility to check the accuracy of your documents. You are responsible to ensure that your first and last name provided to us at the time of booking are exactly as they appear on your valid passport.

8. PASSPORT/VISAS: A valid Government issued photo ID is required at time of check-in for all domestic flights. A valid passport is required for travel outside the United States. Many countries require that a visitor’s passport be valid for up to six months beyond the date of return from their country. All travelers are responsible to contact the consulate of Costa Rica for entry requirements and necessary documentation, such as visas. For the latest information on travel requirements, log on to the Costa Rica consulate website. Non-U.S. citizens may have different entry requirements than U.S. citizens.

9. SPECIAL REQUESTS: We will make reasonable efforts to secure special request and dietary needs. However, we cannot be held responsible for the failure of carriers, hotels, or other suppliers to deliver such requests.

10. TRAVELERS REQUIRING SPECIAL ASSISTANCE: Any disability requiring special attention must be reported to us at the time the reservation is made. We will make reasonable attempts to accommodate the special needs of travelers, but are not responsible for denial of services by carriers, hotels, or other suppliers. We regret that we cannot provide individual assistance for walking, dining, embarking/disembarking transportation, and/or for other personal needs. A qualified companion must accompany travelers who need such assistance and will be subject to program fees.

11. SINGLE SUPPLEMENT/ROOM SHARES: Our prices are per person, based on double occupancy.  Single accommodations are subject to availability, and may be confirmed for an additional charge. Upon request, we will attempt to pair you with a roommate of the same gender. If we are unable to find you a roommate before the departure, a single supplement will apply. In addition, we cannot guarantee that the room-share arrangement will be to your satisfaction.

Once on the tour, if either roommate decides they prefer a single room, they will be required to pay the single supplement for both rooms; their own, as well as their roommate’s. We will charge the credit card on file for the traveler who is responsible for requesting this change.

13. GRATUITIES: All hotel and meal gratuities are included in the price. However, gratuities for the tour director, hosts, local guides, drivers and hotel staff are not included and are at the discretion of the individual traveler.

14. CANCELLATION PENALTIES AND REFUNDS: Cancellation penalties will be strictly enforced. If you must cancel your reservation, the effective date of the cancellation will be the first weekday your cancellation notice is received by fax, overnight courier, or mail. Cancellation charges are equivalent to the price of the program. Your non-refundable charges will be retained in addition to any fees or penalties.

15. ITINERARY VARIATIONS: We make commercially reasonable efforts to operate all tours as advertised. Situations may arise, voluntarily or involuntarily, that require changes or exceptions in the airport of departure or the itinerary. On these occasions, we reserve the right to make such modifications and substitute conveyances/hotels as deemed necessary.

16. TOUR CANCELLATIONS: We reserve the right to cancel the entire trip (or any component of the trip) for any reason and/or time. In this event, our liability, if any, shall be limited to and liquidated by refunding to each prospective participant the payments made proportionate to the cost of program component cancelled.

17. PHOTOGRAPHY RELEASE: You hereby voluntarily authorize and give us permission for the non-exclusive use of photographs, video, electronic and digital reproductions in any form of your person or personal property in connection with any video and/or audio captured as part of your tour. You also grant us and our designees the right to use your name, likeness, image voice, appearance, and performance as embodied in our website (the “Content”) whether recorded on or transferred to videotape, film, slides, photographs, the Internet, audio tapes, or other media, now known or later developed. This grant includes without limitation the right to edit, mix or duplicate and to use or re-use the Content in whole or part as we may elect.

18. PROHIBITED ACTIVITIES: While you may make limited copies of your travel itinerary (and related documents) for travel or services booked through this website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this website. Additionally, you agree not to:

(i) use this website or its contents for any commercial purpose;

(ii) make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;

(iii) access, monitor or copy any content or information of this website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;

(iv) violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this website;

(v) take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;

(vi) deep-link to any portion of this website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or

(vii) “frame”, “mirror” or otherwise incorporate any part of this website into any other website without our prior written authorization.

19. LIMITATION OF LIABILITY: IN NO EVENT SHALL GREEN LLC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO, DISPLAY OF OR USE OF THIS WEBSITE OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY OR USE THIS WEBSITE (INCLUDING, BUT NOT LIMITED TO, YOUR RELIANCE UPON OPINIONS APPEARING ON THIS WEB SITE; ANY COMPUTER VIRUSES, INFORMATION, SOFTWARE, LINKED SITES, PRODUCTS, AND SERVICES OBTAINED THROUGH THIS WEBSITE; OR OTHERWISE ARISING OUT OF THE ACCESS TO, DISPLAY OF OR USE OF THIS WEBSITE) WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF GREEN LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If, despite the limitation above, GREEN LLC is found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of GREEN LLC will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to GREEN LLC in connection with such transaction(s) on this website, or (b) One-Hundred Dollars (US$100.00) or the equivalent in local currency.

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of GREEN LLC, and/or its respective suppliers.

20. INDEMNIFICATION: You agree to defend and indemnify GREEN LLC, owners, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

a. your breach of this Agreement or the documents referenced herein;

b. your violation of any law or the rights of a third party; or

c. your use of this website.

21. RESPONSIBILITY: GREEN LLC acts only as a sales agent for hotels, car rental companies, transfer companies, sightseeing companies, or other service providers named on your ticket, other travel documents, or your itinerary (“Suppliers”). GREEN LLC is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules. GREEN LLC assumes no responsibility for, and shall not be liable for, any refund, personal injury, property damage (including damaged baggage), or other loss (including lost baggage), accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any force majeure, including but not limited to, acts of God, war or terrorism; or (4) any wrongful or negligent acts or omissions on the part of any other party not under GREEN LLC’s control.

GREEN LLC has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, GREEN recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, GREEN LLC recommends contacting the Centers for Disease Control at (877) FYI-TRIP or wwwnc.cdc.gov/travel/. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release GREEN LLC from all claims arising out of anything covered by this paragraph.

22. GENERAL: This website is operated by a U.S. entity and this Agreement is governed by the laws of the State of New Jersey, USA. You hereby consent to the exclusive jurisdiction and venue of courts in Middlesex County, New Jersey, USA, in all disputes arising out of or relating to the use of this website. Use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, or employment relationship exists between you and GREEN as a result of this Agreement or use of this website.

Our performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of this website or information provided to or gathered by us with respect to such use. To the extent allowed by applicable law, you agree that you will bring any claim or cause of action arising from or relating to your access or use of this Website within one (1) years from the date on which such claim or action arose or accrued or such claim or cause of action will be irrevocably waived.

If any part of this Agreement is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired.

This Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and GREEN LLC with respect to this website and the subject matter therein and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and GREEN LLC ith respect to this website and the subject matter herein. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
